Legal Requirements

State motor vehicle office: Tennessee Motor Vehicle Division, 500 Deaderick St., Nashville, Tennessee 37242

Self-help repossession is legal. Must be peaceful – no breaching the peace.

Liens get recorded in the Registrar’s office. In the county where the debtor lives. If they’re out of state, file where the property is. Tennessee adopted UCC standards in 1964.

Liens must appear on the title card from DMV. Liens not dependent on possession aren’t valid. unless noted on the title.

Debtor rights: Ten-day redemption period.

After recovery: Deficiency balances permitted under state law.

Title transfer needs. Certificate of title with lien release. Notarized affidavit of repossession, Bill of Sale, and odometer statement.

Plates: Stay with the owner after recovery.
