What makes Louisiana different:

Louisiana doesn’t allow standard self-help repossession like other states. The debtor must sign a voluntary surrender. And release the document before we can take possession. This makes recovery more complicated than neighboring states.

Parish recording: Liens get recorded on a parish basis. Chattel mortgages must be recorded with the Commissioner of Motor Vehicles. And with the Clerk of Court in the parish where the debtor lives.

No redemption after sale: Once the collateral is sold, the debtor cannot redeem it.

Deficiency limitations:

Deficiency judgments aren’t permitted. Unless the asset was seized through court proceedings under a chattel mortgage foreclosure. Confession of judgment notes are invalid in Louisiana.

Title transfer requirements:

Title must be in lienholder’s name (from any state). Plus a notarized Bill of Sale showing amount, buyer’s name, and sale date. Also requires a notarized affidavit of repossession. And a completed, notarized Bill of Sale.

Plates: Remain with the vehicle after recovery.
